INVITATION FOR BIDS - McConnellsburg Curb Cuts Phase II

The Fulton County Commissioners will receive sealed bids, one (1) original and one (1) copy for “McConnellsburg Curb Cuts Phase II” at their office until 10:30 a.m. prevailing time on Tuesday, February 14, 2023, at the Fulton County Commissioner’s Office at 116 West Market Street, McConnellsburg, PA, 17233, at which time and place, all bids will be publicly opened and read aloud.

The project consists of the following: McConnellsburg Borough ADA curb cuts at various locations in McConnellsburg Borough. Project includes demolition, concrete curbs, concrete sidewalks, paving patch and seeding.

A non-mandatory Pre-Bid Meeting will be held for prospective bidders at the Borough of McConnellsburg Office, Fulton House, 112 Lincoln Way East, McConnellsburg, PA 17233 on Friday, February 6, 2023 at 11:00 a.m.

Copies of the Contract Documents may be examined and obtained at the office of the Fulton County CDBG Office located at 116 West Market Street, McConnellsburg, PA 17233 Attn: Patti Hess. Bidding Documents may be obtained for a non-refundable fee of $75.00 or pdf versions for no cost. Checks shall be made payable to CES Engineering, LLC. A certified check or bank draft payable to the order of The Fulton County Commissioners, or a satisfactory Bid Bond executed by the Bidder and an acceptable surety in an amount equal to ten percent (10%) of the total of the Bid, shall be submitted with each bid. The Bidder shall include the fully completed Non-Collusion Affidavit with the bid.

A Performance and Payment Bond in an amount equal to 100% of the amount of the contract and issued by a corporate surety authorized to do business in the Commonwealth of Pennsylvania will be required to be furnished by the successful bidder.

Compliance with Act 127 of 2012 requiring all contractors and subcontractors to use e-Verify for verification of employment eligibility for all employees will be required. Verification form shall be provided to the Fulton County Commissioners as a precondition of being awarded a contract.

In addition to the Equal Employment requirements of Executive Order 11246 regarding discrimination, the CONTRACTOR must establish a 6.9% goal for female participation and a 1% goal for minority participation in his/her aggregate on-site construction workforce for contracts in excess of $10,000.

Fulton County is utilizing federal funds for this project and has adopted a Minority and Women Business Enterprise (MBE/WBE) in accordance with Executive Orders 11625, 12138, and 12432 and a Section 3 Action Plan in accordance with Title 24 Part 135 Code of Federal Regulations. As such, the bidders/offerors must submit documentary evidence of minority and women business enterprises and Section 3 business concerns who have been contacted and to whom commitments have been made. Documentation of such solicitations and commitments shall be submitted with the bid.

Moreover, the CONTRACTOR shall strive to meet the MBE goal of 5% and the WBE goal of 3% for contracts of $25,000 or more. The Section 3 Action Plan applies to projects which the amount of HUD or CDBG funding exceeds $200,000, which requires the CONTRACTOR to attempt to meet the minimum numerical goals of which 25% or more of the total number of labor hours worked by all workers on a Section 3 project are Section 3 workers, per 24 CFR Part 75.19; and 5% or more of the total number of labor hours worked by all workers on a Section 3 project are Targeted Section 3 workers, as defined in 24 CFR Part 75.21. The County, in accordance with its Section 3 Action Plan, 00030-2 may provide a bid preference to a bidder who is a Section 3 business concern. MBE/WBE and Section 3 business concerns shall be afforded full opportunity to bid without discrimination.

Bids may be held by the County for up to 60 days from the date of opening for the purpose of reviewing the bids and investigating the qualifications of bidders prior to awarding the contract. The County reserves the right to reject any or all bids, to waive any irregularities, or to negotiate contract amounts.

The project is federally funded and subject to all related federal regulations. Davis-Bacon and related Acts apply to this contract.

Awards shall be made only to responsible bidders that possess the potential ability to perform successfully under the terms and conditions of this procurement. Consideration shall be given to such matters as bidder integrity, compliance with public policy, record of past performance and financial and technical resources when determining responsibility.
